Contact: hello@bossfeed.fun · [mailing address]
These Terms of Use ("Terms") cover every site and game we run under the Final Boss Games name, including:
- bossfeed.fun and its other addresses (bossgames.fun, theboss.games and their www versions),
- surviversus.com,
- finalbossediting.com,
- our party games, daily puzzles and games played on those sites, and
- versions of our games published on game portals (for example itch.io, Viverse and CrazyGames), to the extent those games connect to our servers.
Together these are the "Services". By using the Services you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.
1. Who can use the Services
- The Services are for a general audience. They are not directed at children under 13.
- You must be at least 13 years old to create an account, post, comment, upload images, join leaderboards under a chosen name, or sign up for emails. When you create an account you confirm this by ticking a box.
- If you are 13 to 17, you need permission from a parent or guardian, and they agree to these Terms for you.
- If we learn that an account belongs to someone under 13, we will close it and delete its personal data.
- You may play many games without an account. Some features give you a random anonymous ID so your votes and progress work (see the Privacy Policy).
2. Your account
- You can sign in with Google or with an emailed sign-in link (and with Apple in our app). You are responsible for activity on your account and for keeping access to your email or Google account secure.
- Pick a display name that follows the content rules in Section 5. Display names, avatars and scores you submit to public leaderboards are public.
- Tell us at hello@bossfeed.fun if you think someone else is using your account.
- You can delete your account at any time from your account page or by emailing privacy@bossfeed.fun (see the Privacy Policy, "Your choices and rights").
3. Our content and your licence to use it
The games, puzzles, artwork, text, music, code and design of the Services belong to us or to the people who licensed them to us. We give you a personal, non-exclusive, non-transferable, revocable licence to use the Services for your own non-commercial entertainment, in line with these Terms.
Some puzzles are printable. You may print them for personal, classroom or household use. Do not resell them or republish them in bulk without our written permission.
Some content shown in the Services comes from third parties (for example embedded YouTube videos, Bluesky posts, RSS headlines, quotations and public-domain or openly licensed works). That content belongs to its owners and is subject to their terms. Embeds and links do not mean that the owner endorses us or that we endorse them.
4. Content you post ("User Content")
User Content means anything you submit: posts, comments, images, votes, puzzle or story submissions, display names, avatars, party-game drawings and answers, and similar material.
- You keep ownership of your User Content.
- Licence to us: you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy, display, adapt (for example resize, crop or format), and distribute your User Content in order to run, show and promote the Services. This includes showing it in the feed, on leaderboards, in share images and in social posts that promote the Services. The licence ends when you delete the content or your account, except: (a) copies others have already shared or that sit in backups for a limited time, and (b) content you submitted for publication (for example an accepted puzzle or story submission), where the licence continues for the content as published unless we agree otherwise in writing.
- Your promises: you have the rights needed to post it, and it does not break the law or these Terms.
- Public by default: posts, comments, display names and leaderboard entries can be seen by anyone and may be indexed by search engines. Do not post private information.
- We may review, refuse, edit for formatting, or remove any User Content, but we do not have to monitor it and we are not responsible for what other users post.
5. Content rules and acceptable use
Do not use the Services to:
- Post anything illegal, or anything that harasses, threatens, bullies, or encourages harm to anyone.
- Post hate speech or content that attacks people for who they are (for example race, ethnicity, religion, sex, gender identity, sexual orientation, disability or national origin).
- Post sexual content, nudity, or graphic violence. Never post any content that sexualizes minors; we report it to the authorities.
- Post someone else's private information (addresses, phone numbers, emails, ID numbers, photos of private people without permission).
- Infringe copyright, trademark or other rights, or post content you do not have the right to share.
- Spam, advertise without permission, run scams, or impersonate someone.
- Cheat: use bots, scripts, exploits or modified clients to manipulate scores, leaderboards, votes, Sparks, Crowns or other rewards, or create multiple accounts to do so.
- Interfere with the Services: attack, overload, scrape at scale, probe for security holes without permission, or get around rate limits, bot checks or bans.
- Use the Services to train artificial intelligence models, or copy puzzles and content in bulk, without our written permission.
We may remove content, reset scores, remove rewards, limit features or suspend or close accounts that break these rules. Where reasonable, we will tell you why.
Reporting: use the report option where available or email hello@bossfeed.fun.
6. Copyright complaints
If you believe content on the Services infringes your copyright, send a notice to privacy@bossfeed.fun (subject "Copyright notice") including: your contact details; the work you claim is infringed; the URL of the material; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We will remove material where appropriate and close repeat infringers' accounts.
7. Virtual items: Sparks, Crowns, cosmetics and rewards
- Sparks, Crowns, keys, cosmetics, badges, creatures and other in-game items are free rewards with no cash value. You cannot buy them with money today, sell them, trade them outside the Services, or exchange them for money.
- They are a limited licence, not your property. We may change, rebalance or remove them, for example to fix bugs or stop cheating.
- If we ever sell anything for money, we will show the price and terms clearly before you pay, and update these Terms first.
8. Emails
We only send the daily puzzle email or the Sunday newsletter if you turn them on. Every one has a one-click unsubscribe link, and you can unsubscribe at any time. We also send emails you ask for or need, such as sign-in links. See the Privacy Policy.
9. Third-party services and game portals
The Services rely on and link to services run by others (for example Google sign-in, YouTube, Bluesky, Discord and game portals like itch.io, Viverse and CrazyGames). Their own terms and privacy policies apply when you use them. If you play our game on a portal, that portal's terms also apply to your use of the portal.
10. Changes to the Services
The Services are free and offered as they are. We may add, change, pause or remove games, features or content at any time. Daily content may be replaced. We do not promise any particular availability or uptime.
11. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT SCORES, PROGRESS OR CONTENT WILL BE SAVED. Puzzles, quotations, trivia, history and other educational or informational content are for entertainment and may contain errors. Some places do not allow these exclusions, so some may not apply to you.
12. Limit of liability
TO THE FULLEST EXTENT ALLOWED BY LAW:
- WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROGRESS, VIRTUAL ITEMS, PROFITS OR GOODWILL, ARISING FROM OR RELATED TO THE SERVICES OR THESE TERMS.
- OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES OR THESE TERMS IS LIMITED TO US $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.
These limits do not apply to liability that cannot be limited by law (for example for fraud, or for gross negligence or willful misconduct where California law does not allow a limit).
13. Indemnity
If someone brings a claim against us because of your User Content or your breach of these Terms, you agree to cover our reasonable costs and losses from that claim, to the extent allowed by law.
14. Ending your use
You may stop using the Services and delete your account at any time. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering a Service. Sections 3 (ownership), 4 (licence for content already published or submitted for publication), 7, 11, 12, 13, 15 and 16 continue after your access ends.
15. Disputes and governing law
- These Terms are governed by the laws of the State of California and applicable US federal law, without regard to conflict-of-law rules.
- Talk to us first. Before filing a claim, email hello@bossfeed.fun with a description and give us 30 days to try to resolve it informally.
- Where claims go. Either side may bring an individual claim in small claims court if it qualifies. Otherwise, claims must be brought in the state or federal courts located in [county], California, and both sides consent to those courts.
- If you are a consumer in another country, you keep any mandatory rights your local law gives you.
16. General
- Entire agreement: these Terms, the Privacy Policy and any feature-specific rules we show you are the whole agreement between you and us about the Services.
- Severability: if any part is unenforceable, the rest stays in effect.
- No waiver: not enforcing a right right away does not waive it.
- Assignment: we may transfer these Terms to a successor (for example if we form a company or the Services are sold). You may not transfer them without our consent.
- Force majeure: we are not responsible for delays or failures caused by events beyond our reasonable control (for example outages at our hosting providers, natural disasters or war).
- California users: under California Civil Code section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
17. Changes to these Terms
We may update these Terms. We will change the "Last updated" date and, for material changes, give notice on the site or by email before they take effect. Continuing to use the Services after the change means you accept it.
